By downloading, installing, or using the Intellist mobile application ("the app," "Intellist," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.
These Terms apply to all users of Intellist, including users of the free tier and users who subscribe to Intellist Pro. By subscribing to Intellist Pro, you also agree to the subscription-specific terms described in Section 5 below.
These Terms are supplemented by our Privacy Policy, which describes how we collect, use, and protect your data. By using the app, you also agree to the Privacy Policy.
Intellist is a mobile application for iOS that helps users create and manage lists, track home inventory, and organize physical storage using NFC (Near Field Communication) tags. The app allows users to attach NFC stickers to physical containers—such as storage boxes, pantry shelves, freezer drawers, and garage bins—and tap their iPhone to instantly view and update the contents of that container.
Core features of the app include flexible list creation (checklists, shopping lists, to-do lists, and inventory lists), room-based organization, item quantity tracking, smart automations that generate shopping list items from low inventory, quick actions, and group sharing for families and households.
The app is designed as an offline-first application. All content is stored locally on your device and synced to our cloud infrastructure when an internet connection is available.
You must be at least 13 years of age to use Intellist. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the app with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.
By using the app, you represent and warrant that you meet these eligibility requirements.
To use Intellist, you must create an account using an email address or a supported third-party sign-in provider (such as Google Sign-In). You agree to provide accurate and complete information during registration and to keep your account information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@intellist.app if you become aware of any unauthorized access to or use of your account.
You may request deletion of your account and all associated data at any time by contacting us at support@intellist.app. Upon account deletion, all personal data will be permanently removed from our servers in accordance with our Privacy Policy.
Intellist offers a free tier that includes core functionality with up to 3 lists, unlimited items per list, and full NFC tag support. Intellist Pro is a paid subscription that unlocks additional features including unlimited lists, smart automations, and group sharing.
Intellist Pro is available as a monthly or annual subscription for individuals, and as a monthly or annual family subscription supporting up to 6 people through Apple Family Sharing. Current pricing is listed on the App Store and within the app. We reserve the right to change subscription pricing at any time, but price changes will not affect active subscriptions until the next renewal period.
All subscriptions are billed through Apple's App Store. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
We may offer free trial periods for Intellist Pro. If a free trial is offered, you will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged the applicable subscription fee. Trial eligibility is determined by Apple and is typically limited to one trial per Apple ID.
You can manage or cancel your subscription at any time through your Apple ID account settings or the App Store. Cancellation takes effect at the end of the current billing period—you will retain access to Pro features until that date. We do not provide prorated refunds for partial billing periods.
All purchases are made through the Apple App Store. Refund requests are handled by Apple in accordance with their refund policies. We do not process refunds directly.
Family subscription plans are shared through Apple Family Sharing. Up to 6 family members can access Intellist Pro under a single family subscription. Family Sharing setup, member management, and billing are governed by Apple's Family Sharing terms and policies.
You agree to use Intellist only for lawful purposes and in accordance with these Terms. You agree not to:
You retain full ownership of all content you create, upload, or store in Intellist, including but not limited to lists, items, item photos, descriptions, inventory data, automations, actions, and any other data you input into the app (collectively, "User Content").
By using the app, you grant us a limited, non-exclusive, royalty-free license to store, process, transmit, and display your User Content solely for the purpose of providing, maintaining, and improving the Intellist service. This license exists only for as long as your account is active and your content is stored on our systems. We will not use your User Content for advertising, marketing, or any purpose other than operating the service.
If you share content through Intellist's group sharing feature, other members of your group will be able to view, edit, and interact with the shared lists, items, actions, and automations. You are responsible for the content you share and should only share content you have the right to share. You can leave a group or remove shared content at any time.
You are solely responsible for your User Content. We do not monitor, review, or endorse User Content. We reserve the right to remove any content that violates these Terms, but we are under no obligation to do so.
Intellist allows you to write data to and read data from NFC (Near Field Communication) tags using your iPhone. NFC tags are third-party physical products that you purchase separately; they are not manufactured, sold, or warranted by Intellist.
When you use Intellist to write data to an NFC tag, the app stores a link on the tag that points to a list within the app. Writing to an NFC tag will overwrite any existing data on that tag. You are responsible for ensuring you have the right to write to any NFC tag you use with the app.
We are not responsible for the performance, durability, compatibility, or failure of any NFC tags or other physical hardware. NFC tag functionality depends on your iPhone model and iOS version. iPhone 7 and later support NFC tag reading; iPhone XS and later support both reading and writing.
The Intellist app, including its design, code, user interface, graphics, logos, icons, and all associated documentation and content (excluding User Content), is owned by Intellist and is protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws. All rights not expressly granted to you under these Terms are reserved by us.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the app on any iPhone that you own or control, solely for your personal, non-commercial purposes. This license does not include the right to modify, distribute, sell, lease, or create derivative works based on the app.
If you provide us with suggestions, ideas, feedback, or other input regarding the app ("Feedback"), you grant us an unrestricted, irrevocable, royalty-free license to use, modify, and incorporate that Feedback into the app or our business in any way, without obligation or compensation to you.
Intellist integrates with certain third-party services to operate, including Supabase (cloud database and authentication), RevenueCat (subscription management), and Google Sign-In (optional authentication). Your use of these services is subject to their respective terms of service and privacy policies.
We are not responsible for the availability, accuracy, or practices of any third-party services. If a third-party service experiences downtime or discontinues operation, certain features of Intellist may be temporarily or permanently affected.
INTELLIST IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the app will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that the app will meet your specific requirements or expectations, or that any data stored in the app will be accurate, reliable, or preserved indefinitely.
You acknowledge that the app is a tool for personal organization and that the accuracy of your inventory, lists, and other data depends on the information you input. We are not responsible for losses resulting from inaccurate or incomplete data entry.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL INTELLIST, ITS OWNER, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR COST OF PROCUREMENT OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY UNITED STATES DOLLARS ($50.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless Intellist and its owner, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the app; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.
We reserve the right to suspend or terminate your access to the app at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. You may stop using the app and request account deletion at any time.
Upon termination, your right to use the app ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including but not limited to Sections 7 (User Content), 9 (Intellectual Property), 11 (Disclaimer of Warranties), 12 (Limitation of Liability), 13 (Indemnification), and 16 (Governing Law).
We may update or modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where practicable, by providing notice through the app. Your continued use of the app after any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you should stop using the app.
These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or your use of the app shall be resolved exclusively in the state or federal courts located in Louisiana, and you consent to the personal jurisdiction of such courts.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Intellist regarding your use of the app and supersede any prior agreements.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
These Terms do not create any third-party beneficiary rights, except that Apple, Inc. is an intended third-party beneficiary of these Terms solely with respect to the provisions relating to the App Store and subscriptions, and Apple may enforce those provisions directly.
